App Privacy Policy

Introduction

Cape Town International Jazz Festival ("we" or "us" or "our") respects the privacy of users of our mobile application ("App") and we remain committed to protecting your privacy and the Personal Information that you provide to us. We subscribe to, and comply with, the principles described in the Protection of Personal Information Act, No. 4 of 2013 ("POPIA").

This App Privacy Policy explains how we collect, use, disclose and safeguard the Personal Information that you provide to us when you download, install, access or use the Jazz Festival mobile application, including any related services, features or digital functionality made available through the App. Please read this App Privacy Policy carefully before using the App or submitting any Personal Information.

We reserve the right to make changes, updates, additions, removals and/or amendments to this App Privacy Policy. Such changes will become effective from the date of their publication on the App or associated festival website. You are encouraged to periodically review this App Privacy Policy to stay informed of updates. Your continued use of the App will constitute your acceptance of any revised version.

By downloading, installing or using the App, you confirm that you have read and agree to the terms of this App Privacy Policy.

Definitions

Data means information in electronic form.

Data subject means the person to whom Personal Information relates.

IP address means a unique address that identifies a device on the internet or local network.

Personal Information means any information linked to you or information that can identify you, including but not limited to:

  • Information relating to your gender, nationality, ethnic or social origin, age or language.
  • Your identity number, e-mail address, physical address, telephone number, location information or mobile device identifier.
  • Device-specific information such as device type, operating system, hardware model and unique device identifiers.
  • Your personal preferences regarding festival events.
  • Correspondence sent by you which is of a private or confidential nature.
  • The views or opinions of others about you.
  • Your name if it appears with other personal information relating to you.

Process means, in relation to Personal Information, any operation or activity as set out in POPIA.

Collection of Personal Information

Where Personal Information is submitted to the App by the user - for example through creating an account, enabling App permissions, registering for tickets, or interacting with App features - the following principles are observed:

  1. The App only collects, Processes and stores Personal Information to the extent necessary to:
    • Enable your use of the App and festival-related services.
    • Process ticket purchases, if applicable.
    • Communicate event schedules, updates and urgent notifications.
    • Provide location-based services, such as maps, venue navigation and safety alerts.
    • Customise user experience.
    • Comply with a legal obligation.
    • Pursue a legitimate interest of the festival, unless you object on reasonable grounds.
  2. Information you may provide directly includes:
    • Name, surname and contact details.
    • Email address and mobile number.
    • Account creation details.
    • Payment information, if purchasing festival tickets through the App.
    • Preferences such as favourite artists or scheduled events.
  3. Information collected automatically includes:
    • Mobile device identifiers.
    • Device type, operating system and hardware information.
    • App usage data and interaction analytics.
    • Location data, where you have granted permission.
    • Push notification tokens.
  4. The specific purpose for which information is collected is apparent from the context in which it is requested.
  5. We will not Process your Personal Information for any other purpose without your prior written consent, unless required to do so by law.
  6. When Processing Personal Information on the App, we shall:
    • Comply with all applicable laws.
    • Respect your right to privacy at all times.
    • Ensure that the Personal Information we collect is relevant and not excessive.
    • Ensure that our Processing activities are proportionate to legitimate purposes.
    • Ensure that your rights and interests are not unnecessarily prejudiced.
  7. The App will keep a record of Personal Information for as long as is required to fulfil the purposes for which it was collected, or longer where required by law, contractual necessity, or with your consent.
  8. We will not disclose Personal Information to any third party unless:
    • Such party performs Processing on our behalf, for example payment processors or analytics providers.
    • Prior written consent has been obtained.
    • Disclosure is required by law.
  9. Where authorised Processing is performed by third parties, we will keep a record of the information shared, the recipient, the reason, and the date of disclosure for a period of one year.
  10. Where we are no longer authorised to retain Personal Information, we will delete, destroy or de-identify such information or return it to you upon written request.

Collection of Anonymous Data

To provide the best possible service, the App uses standard mobile analytics technologies to collect anonymised information about App usage. These technologies are not able to personally identify individual users.

We are the sole owners of anonymous information collected by the App. We will not sell this information to anyone.

We may use third-party analytics tools or software development kits ("SDKs") to collect:

  • Device information.
  • Interaction data.
  • Crash logs.
  • Performance data.
  • Aggregated usage patterns.

These tools help us to:

  • Distinguish users.
  • Remember preferences.
  • Estimate audience size.
  • Tailor App content.
  • Improve performance and reliability.

Users may restrict certain tracking technologies through their device settings; however, this may limit functionality.

Access to Personal Data

If a user believes that personal data concerning them is outdated or incorrect, they may request correction by contacting us at info@espafrica.co.za. Requests must specify the incorrect data, the proposed correction, and reasons for the request.

Users may request access to Personal Information held by us under POPIA and the Promotion of Access to Information Act No. 2 of 2000 ("PAIA").

Links to Other Websites

The App may contain links to third-party websites or services, including ticketing partners, sponsors, venue partners, or map services, which are not under our control. You are strongly encouraged to review the privacy policy of any such site before using it.

This App Privacy Policy does not apply to third-party websites or services.

Links to Social Networking Services

We may use social networking services such as Facebook, Instagram, TikTok or X to communicate with the public. If you engage with us through such services, the social networking platform may collect your Personal Information for its own purposes.

If the App permits social log-in, for example "Sign in with Google" or "Sign in with Facebook", we may receive certain account information from those platforms.

Security

We are committed to protecting Personal Information against loss, damage, unauthorised access or destruction. We implement appropriate and reasonable technical and organisational safeguards, including encryption, secure servers, access controls and secure API communication.

Where third-party operators Process Personal Information on our behalf, they shall:

  1. Not Process Personal Information without our authorisation.
  2. Treat all such information as confidential.
  3. Implement security measures similar to those we employ.
  4. Notify us immediately upon any suspected data breach.
  5. Comply with applicable data protection laws.
  6. Notify us of any onward disclosure.

We will ensure that Personal Information is appropriately backed up and safeguarded.

We cannot be held liable for loss or damage arising from the intentional or accidental release of information by an employee or third party.

Children's Personal Information

We shall not Process any Personal Information relating to a person under the age of 18 unless consent has been obtained from that person's parent or legal guardian.

If a parent or guardian provides such information, they expressly consent to its Processing under this policy.
